PUBLIC OFFER
for the provision of services of the "MineGuard" service
In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (CC RK), this document constitutes a public offer. In accordance with Article 396 of the CC RK, the unconditional acceptance (acception) of the terms of this offer is the Customer's payment for the Services or registration in the Control Panel.
This document is a public offer of Individual Entrepreneur Kulichenko Olga Nikolaevna, IIN 770530400037, acting on the basis of business activity notification No. KZ89UWQ05650293 (hereinafter referred to as the Contractor), and contains a proposal to enter into a paid service agreement for server protection against DDoS attacks and traffic filtering using the website https://mineguard.pro/ (hereinafter referred to as the Website).
1. TERMS AND DEFINITIONS
1.1.Website – the Internet resource of the Contractor, located at: https://mineguard.pro/, through which the Services are provided and access to the Control Panel is granted.
1.2.Control Panel (Personal Account) – a restricted section of the Website providing the Customer with access to service management functionality, including domain, backend, and protection parameter settings, as well as subscription and balance management.
1.3.Services – providing the Customer with access to the Contractor's software and hardware complex (Filter), designed for analyzing and cleaning network traffic to protect the Customer's servers from DDoS attacks and other types of malicious network activity.
1.4.DDoS Attack (Distributed Denial of Service) – a distributed network attack in which multiple devices simultaneously direct a significant volume of requests or traffic at a server to disrupt its normal operation or make it completely unavailable to legitimate users.
1.5.Filter – the Contractor's software and hardware complex functioning as an intermediate network node (reverse proxy), receiving incoming user traffic, analyzing it, and forwarding only traffic deemed legitimate to the Customer's server.
1.6.Backend – a server or group of servers of the Customer to which the Filter redirects verified traffic. Server addresses are specified by the Customer independently through the Control Panel.
1.7.Domain – a domain name through which users connect to the Customer's server via the Filter infrastructure.
1.8.Network (Project) – a logical entity in the Contractor's system that combines one or more domains, backends, and protection parameters related to one server or a group of related servers of the Customer.
1.9.Mitigation – an enhanced traffic filtering and analysis mode, activated automatically by the Contractor's system upon detecting signs of a DDoS attack or manually by the Customer, in which additional mechanisms for verifying incoming connections are applied.
1.10.CAPTCHA – an interactive user verification mechanism designed to confirm that the connection is initiated by a human, not an automated program or bot.
1.11.Firewall – a set of network traffic filtering rules that allow restricting or permitting access based on IP addresses, countries, networks, or other connection parameters. Configured by the Customer through the Control Panel.
1.12.VPN/Proxy Blocking – functionality for restricting or blocking connections made through known VPN services and proxy servers.
1.13.Traffic – the total volume of data passing through the Filter infrastructure during the provision of Services, measured by the Contractor's system in terabytes (TB).
1.14.Freeze – a state of a resource (domain, backend, or protection settings) in which its configuration is preserved in the Contractor's system, but traffic processing by the Filter is temporarily suspended, including in the event of the Customer's subscription expiration or tariff plan change.
1.15.Bedrock Tunnel – a specialized network channel enabling Minecraft Bedrock Edition users to connect to the Customer's server through the Filter infrastructure.
1.16.Java Edition – a version of Minecraft designed for personal computers using the TCP network protocol.
1.17.Bedrock Edition – a version of Minecraft designed for mobile devices, gaming consoles, and certain versions of Windows, using the UDP network protocol.
1.18.PlasmoVoice – a third-party modification of Minecraft software that adds voice chat functionality and is not a product of the Contractor.
1.19.Customization – a functional capability allowing the Customer to modify certain parameters of user interaction with the service, including the design of verification pages, system messages, and other interface elements.
1.20.Policies – integral parts of this Offer, including but not limited to: the Privacy Policy, Consent for Personal Data Processing, and Refund Policy.
1.21.Customer – a legally capable individual who has reached the age of 18, registered on the Website or in the Service Control Panel, accepted the terms of this Offer, and uses the Service for connecting and protecting a game server.
1.22.Shared Access (subaccounts) – a functional capability of the Service allowing the Customer to grant limited service management rights to third parties within their account.
2. SUBJECT OF THE AGREEMENT
2.1.The Contractor undertakes to provide the Customer with access to Services for protecting the Customer's game servers from DDoS attacks and malicious network traffic through the use of the Contractor's software and hardware complex (Filter), and the Customer undertakes to accept and pay for such Services in accordance with the terms of this Agreement and the selected Tariff.
2.2.The Filter functions as an intermediate network node (reverse proxy server): users (players) connect to the Contractor's infrastructure, after which incoming connections are analyzed and verified (legitimate) traffic is redirected to the Customer's Backend.
2.3.Within the scope of providing Services, the Contractor ensures the technical capability to protect game servers operating on the following platforms and protocols:
- Minecraft Java Edition;
- Minecraft Bedrock Edition (including through the use of Bedrock tunnels);
- connections related to the use of third-party modifications, including PlasmoVoice, subject to their technical compatibility with the Contractor's infrastructure.
2.4.The Customer is granted access to the Control Panel, through which they may:
- configure protection parameters and firewall rules;
- manage domains and backends;
- monitor protection status and receive notifications about network attacks;
- use the application programming interface (REST API) for automating Service management, if such capability is provided by the respective Tariff.
2.5.The Contractor provides the Customer with technical infrastructure for network traffic filtering and is not a hosting provider of the Customer's game servers, unless otherwise expressly provided by the terms of the selected Tariff.
2.6.By using the Service, the Customer confirms that they have reached the age of 18. If the Service is used by a person under the age of 18, such use must be carried out with the consent of legal representatives. The Contractor does not verify age and bears no responsibility for this.
3. PROCEDURE FOR CONCLUDING THE AGREEMENT (ACCEPTANCE OF THE OFFER)
3.1.This Offer is a public proposal by the Contractor to enter into a service agreement on the terms set forth in this Offer.
3.2.Acceptance of this Offer is recognized as the Customer performing any of the following actions:
- registration on the Website or in the Service Control Panel;
- replenishment of the internal balance in the Personal Account;
- payment of the selected Tariff;
- actual commencement of using the Service.
3.3.From the moment of performing the actions specified in clause 3.2 of this Offer, the Agreement between the Contractor and the Customer is considered concluded in electronic form.
3.4.By accepting this Offer, the Customer confirms that:
- they have fully reviewed the terms of this Offer;
- they understand and accept them in full;
- they undertake to comply with the terms of use of the Service.
4. TECHNICAL CONDITIONS AND FEATURES OF SERVICE PROVISION
4.1.Services are provided on an "as is" basis. The Contractor does not guarantee the continuous availability of the Service or the achievement of a specific level of protection, as methods of network attacks and their implementation are constantly evolving.
4.2.The Contractor makes reasonable technical and commercial efforts to ensure the filtering of malicious traffic; however, it does not guarantee protection against all existing or future types of DDoS attacks, nor against attacks whose intensity exceeds the technical capabilities of the Contractor's infrastructure or data center networks.
4.3.The operation of the Service may be accompanied by false positives of protection mechanisms, as a result of which certain legitimate users may be temporarily restricted in access or required to pass additional verification (e.g., CAPTCHA). Such situations are a possible side effect of the protection systems' operation and are not considered a Service malfunction.
4.4.The Contractor provides network traffic filtering infrastructure and does not store, back up, or administer the Customer's game server data, including game world data, user data, server configurations, and other related data.
4.5.The Contractor is not liable for the unavailability or incorrect operation of the Customer's server if it is caused by circumstances beyond the Contractor's control, including but not limited to:
- failures or limitations of the Customer's server hosting provider;
- insufficient computing or network resources of the Customer's server;
- server software errors;
- incorrect configuration of domain records, Backend addresses, or firewall rules.
4.6.The quality, completeness, and availability of protection features may depend on the Tariff selected by the Customer. Certain protection methods, automation tools, and additional features may be provided exclusively within the corresponding paid Tariffs.
4.7.The use of the Filter as an intermediate network node may lead to increased network latency when users connect. The latency value depends on the geographical location of users, the Contractor's infrastructure, and the Customer's servers and cannot be guaranteed by the Contractor.
4.8.Protocol support features:
- Minecraft Java Edition game servers are serviced through TCP connection proxying;
- Minecraft Bedrock Edition user connections are made through specialized Bedrock tunnels operating on the UDP protocol, which may be accompanied by the loss of individual packets due to the characteristics of this protocol.
4.9.Within the use of the Service, a limit on protected network traffic is established for each Tariff per billing period (calendar month):
- Free: up to 1 (one) TB of traffic;
- Basic: up to 3 (three) TB of traffic;
- Starter: up to 5 (five) TB of traffic;
- Optimal: up to 30 (thirty) TB of traffic;
- Professional: up to 150 (one hundred fifty) TB of traffic.
4.9.1.If the Traffic limit established by the selected Tariff is exceeded, the Contractor may:
- restrict or suspend traffic filtering;
- offer the Customer additional traffic volume or other paid options;
- apply other measures provided by the terms of the respective Tariff.
4.9.2.Current Tariff parameters, including traffic limits and Service capabilities, may also be indicated on the Contractor's Website and in the Control Panel.
4.10.The Customer may use customization features, including CAPTCHA page settings, system messages, and other interface elements. The Contractor does not guarantee the correct display of such elements in modified or unofficial game clients.
4.11.The Contractor may conduct scheduled maintenance, software updates, and other activities necessary to maintain the Service's operability. Information about such work may be published in the Control Panel or through the service's official communication channels.
4.12.Delivery of notifications about network attacks and other events may be carried out using third-party services (including messengers, email services, and other notification systems). The Contractor does not guarantee instant or guaranteed delivery of such notifications.
4.13.The Contractor may provide the Customer with a trial period for the "Basic", "Starter" and "Optimal" tariff plans.
4.13.1.The duration of the trial period is 3 (three) calendar days.
4.13.2.The trial period may be granted only upon simultaneous fulfillment of the following conditions:
- The Customer is a new user of the Service;
- the domain, server, or backend for which the trial period is requested has not previously been under the Service's protection;
- the game server for which the trial period is requested has an average online of at least 15 users.
4.13.4.The Contractor may refuse to provide the trial period if the specified conditions are not met.
4.13.5.Upon expiration of the trial period, the Customer may pay for the corresponding Tariff to continue using the Service's paid features.
4.13.6.In the absence of payment after the trial period ends, the project is automatically transferred to the "Free" tariff, and features available only in paid tariffs become unavailable.
4.13.7.The Contractor may terminate the trial period early upon discovering abuses or attempts to circumvent trial access restrictions.
5. SUBSCRIPTION TERM
5.1.To use the Services, the Customer replenishes their internal balance through available payment methods and then selects a Tariff and billing period.
5.2.The cost of the selected Tariff is deducted from the Customer's internal balance, after which the subscription is considered activated, and the corresponding protection features become available to the Customer.
5.3.Tariff Upgrade. When the Customer transitions to a higher Tariff, changes take effect immediately after the operation is confirmed. New limits and features become available immediately after the Tariff upgrade. If there are previously frozen resources, their service may be automatically restored subject to compliance with the new Tariff limits.
5.4.Tariff Downgrade. The transition to a lower Tariff does not take effect immediately and comes into force at the beginning of the next billing period. Until the changes take effect, the Customer continues to use the Services under the terms of the previously active Tariff. After the downgraded Tariff takes effect, resources exceeding the limits of the new Tariff may be automatically transferred to Freeze mode.
5.5.In the absence of sufficient funds on the internal balance to renew the subscription, the Customer is automatically transferred to the free Tariff (if available). Paid features are disabled, and resources exceeding the free Tariff limits may be transferred to Freeze mode.
5.6.Resources transferred to Freeze mode are temporarily not serviced by the Filter. Their configuration and settings are preserved in the Contractor's system and may be restored upon activation of a Tariff that permits the use of such resources.
5.7.The Contractor is not obligated to send the Customer separate notifications about the subscription expiration date. Information about the subscription term and Tariff status is displayed in the Control Panel. The Customer independently bears responsibility for timely subscription renewal.
6. SERVICE COST AND PAYMENT PROCEDURE
6.1.The cost of Tariffs and additional Services is determined by the Contractor and published on the Contractor's Website and/or in the Service Control Panel.
6.2.All settlements between the Contractor and the Customer are carried out in the national currency of the Republic of Kazakhstan – tenge (KZT).
6.2.1.Tariff prices may be displayed on the Website in other currencies (including RUB, USD, EUR) for informational purposes only. When paying for Services, the payment amount is calculated in tenge (KZT).
6.3.As of the date of publication of this Offer, the Tariff costs are:
- "Free" Tariff — 0 tenge per month;
- "Basic" Tariff — 2,730 tenge per month;
- "Starter" Tariff — 6,020 tenge per month;
- "Optimal" Tariff — 19,530 tenge per month;
- "Professional" Tariff — 60,200 tenge per month.
6.3.1.Additional traffic (add-on) may be purchased separately at a cost of 2,100 tenge per 1 TB of traffic. Purchase is available in packages of 1 to 5 TB. The additional traffic validity period is 1 (one) month from the date of purchase.
6.3.2.The Customer may choose one of the following Service payment periods:
- 1 (one) month — without discount;
- 3 (three) months — 5% discount;
- 6 (six) months — 8% discount;
- 12 (twelve) months — 10% discount.
6.4.Payment for Services is made by replenishing the Customer's internal balance in the Personal Account through payment systems and aggregators integrated with the Website. The Service is considered paid at the moment the cost of the selected Tariff is actually deducted from the Customer's internal balance.
6.5.The Contractor does not store or process the Customer's bank card data. Payment data processing is carried out by the respective payment providers in accordance with their rules and legal requirements.
6.6.Funds deposited by the Customer are credited to the internal balance and used exclusively for paying for Tariffs and additional Services of the Contractor.
6.7.The settlement currency and available payment methods are displayed in the Website/Personal Account interface when making a payment. In case of payment in a currency other than the Tariff currency, conversion is carried out by the payment system at its internal rate.
6.8.The Contractor may change the cost of Tariffs and additional Services unilaterally. The new cost takes effect from the moment of publication on the Website and does not apply to billing periods already paid by the Customer.
6.9.Funds credited to the Customer's internal balance are subject to refund in the manner provided by the Refund Policy and the legislation of the Republic of Kazakhstan.
6.10.The Contractor may provide Customers with promo codes granting the right to a discount when paying for Services.
6.10.1.The terms of promo codes (discount amount, validity period, applicability to tariffs) are determined by the Contractor and may be published on the Website or in other informational materials.
6.10.2.Unless otherwise expressly stated by the Contractor, promo codes are not stackable and may be applied only once per payment.
6.10.3.The Contractor may cancel a promo code if it was obtained or used fraudulently, or if the terms of its use were violated.
7. CONTENT REQUIREMENTS AND SERVICE USAGE
7.1.The Customer undertakes to use the Service exclusively for lawful purposes and bears full responsibility for the activities of game servers connected to the Service, as well as for any content distributed through such servers or placed through the Service's customization features.
7.2.Use of the Service is prohibited for protecting servers or placing content that:
- violates the legislation of the Republic of Kazakhstan;
- is related to the distribution of extremist materials, propaganda of violence, racial, national, or religious hatred;
- contains Nazi symbols or symbols of organizations recognized as extremist or terrorist;
- contains pornographic materials or materials of a sexual nature, including materials involving minors;
- is related to fraud, phishing, distribution of malicious software, or other unlawful activities;
- promotes the use and distribution of narcotic drugs and psychotropic substances;
- violates the rights of third parties, including copyrights, trademarks, or other intellectual property objects;
- contains phishing links or imitations of official Minecraft/Mojang/Microsoft messages intended to deceive players.
7.3.The Customer also undertakes to comply with the rules and terms of use of Mojang Studios software and the Minecraft EULA, as well as other rules of the game's rights holder. The Contractor may suspend or terminate service for servers that violate such requirements.
7.4.The Customer bears responsibility for any content placed through the Service's customization features, including user messages, images, CAPTCHA page text elements, server descriptions, and other textual or graphic materials.
7.4.1.The Customer bears full responsibility for the actions of persons to whom they have granted shared access (subaccounts). The Contractor does not participate in disputes between the Customer and their assistants/administrators.
7.5.The Customer guarantees that the content they place:
- does not violate the rights of third parties;
- is used on lawful grounds;
- does not contain malicious code;
- does not mislead users, including by imitating official messages of game services or rights holders.
7.6.The Contractor may, without prior notice to the Customer:
- remove or restrict access to content that violates the requirements of this Agreement;
- reset customization settings to default values;
- temporarily suspend service for the Customer's project or account;
- completely terminate the provision of Services in the event of a material or repeated violation of the terms of this section.
7.7.Upon discovery of legal violations, the Contractor may transmit relevant information to competent government authorities in the manner established by the legislation of the Republic of Kazakhstan.
7.8.The Customer undertakes to compensate the Contractor for losses, including fines, third-party claims, and legal costs arising from the Customer's placement of prohibited content or use of the Service in violation of this Agreement.
7.9.Violation of the provisions of this section may result in the blocking of the Customer's account or individual projects without prior notice. Refund of funds in such cases is made only in cases expressly provided by the legislation of the Republic of Kazakhstan.
8. LIMITATION OF LIABILITY
8.1.The Contractor is not liable for losses arising from circumstances beyond the reasonable control of the Contractor, including but not limited to:
8.1.1.actions of third parties, including persons carrying out network attacks, hosting providers, communication operators, DNS providers, payment systems, and other organizations ensuring the functioning of network infrastructure;
8.1.2.successful DDoS attacks or other types of network attacks whose intensity exceeds the technical capabilities of the Contractor's infrastructure or data center communication channels;
8.1.3.temporary unavailability or incorrect operation of the Customer's servers caused by limitations of their computing resources, software errors, or actions of the hosting provider;
8.1.4.incorrect configuration by the Customer of domain records (DNS), Backend IP addresses, Firewall rules, or other Service parameters;
8.1.5.characteristics of network protocols used in the operation of game servers, including possible packet loss when using UDP connections (including when using Bedrock tunnels);
8.1.6.operability of third-party software, modifications, or extensions, including voice or other mods for Minecraft (e.g., PlasmoVoice);
8.1.7.increased network latency (latency, ping) caused by traffic proxying through the Filter infrastructure or the geographical location of users, the Customer's servers, and the Contractor's infrastructure;
8.1.8.loss of players, reputational losses, reduced revenues, or other lost profits of the Customer.
8.2.Except in cases expressly provided by the legislation of the Republic of Kazakhstan, the Contractor is not liable for indirect losses, lost profits, loss of business reputation, data loss, or other similar consequences arising in connection with the use or inability to use the Service.
8.3.The aggregate liability of the Contractor under this Agreement is limited to the amount actually paid by the Customer for the current billing period (month) in which the basis for the claim arose.
9. DATA PROCESSING AND STORAGE
9.1.The Contractor collects, processes, and stores personal data of the Customer and Players (visitors to the Customer's servers) in accordance with the requirements of the RK Law "On Personal Data and Their Protection" and the Privacy Policy posted on the Website.
9.2.For the purposes of this Agreement (ensuring protection and traffic filtering), the Contractor processes the following technical data:
- Customer Data: registration data (email), IP addresses of access to the Personal Account, technical Backend parameters, and filtering settings.
- Player Data: IP addresses, gaming nicknames, Minecraft account UUIDs, technical connection metadata (client version, session time and duration, traffic volume).
9.3.The Customer understands and agrees that the processing of Player Data (clause 9.2) is an integral part of the technological process of traffic filtering. The Contractor does not use Player Data for marketing purposes and does not transfer them to third parties, except in cases provided by the legislation of the Republic of Kazakhstan.
9.4.Processing limitations:
- The Contractor does not have access to the contents of game worlds, server files, or the Customer's databases (Backends).
- The Contractor does not process or store the Customer's bank card data.
9.5.In accordance with Article 12 of the RK Law "On Personal Data and Their Protection," the collection and processing of data of subjects located in the Republic of Kazakhstan are carried out on databases located in the territory of the Republic of Kazakhstan.
9.5.1.The data retention period is determined by the Privacy Policy but is at least 5 (five) years for Customer data (in accordance with the tax legislation of the Republic of Kazakhstan). Technical logs and Player data are stored for the period necessary to ensure security and analyze attacks.
9.6.The Customer, as the owner of the protected resource, is obligated to independently notify their Players that their traffic passes through the MineGuard filtering system.
9.6.1.By accepting this Offer, the Customer guarantees that they have legal grounds for transferring Players' technical traffic to the Contractor for the purposes of ensuring information security.
10. INTELLECTUAL PROPERTY
10.1.The Service software, including the Filter, Control Panel, program code, interfaces, databases, and other elements of the Service, are objects of intellectual property of the Contractor and are protected in accordance with the legislation of the Republic of Kazakhstan.
10.2.The Customer is granted a limited non-exclusive right to use the Service exclusively for the purpose of receiving Services under the terms of this Offer.
10.3.The Customer is prohibited from:
- decompiling, reverse engineering, and/or analyzing the Service's program code;
- copying, reproducing, or distributing the Service software;
- using software components of the Service outside the scope of its functional purpose.
10.4.The Contractor does not acquire rights to content placed by the Customer within the use of the Service. The Customer grants the Contractor a non-exclusive license to store and display such content exclusively for the purpose of providing Services.
10.5.Trademarks related to the Minecraft game, including the names and designations of Mojang Studios, belong to the respective rights holders. The MineGuard Service is an independent service and is not an official product of said companies.
11. PROHIBITED TYPES OF SERVERS
11.1.The Customer is prohibited from using the Service to protect servers that:
- are used for organizing gambling with real money in violation of the legislation of the Republic of Kazakhstan;
- violate the rules of use of the Minecraft game and the licensing terms of the rights holders;
- distribute pirated content or software in violation of copyright;
- are used for fraud, phishing, or collecting users' personal data through deception;
- contain extremist materials, pornographic content, or other materials prohibited by law;
- are used for activities not related to the operation of Minecraft game servers.
11.2.The Contractor may temporarily suspend or terminate the provision of Services upon discovering violations of this section.
12. FORCE MAJEURE
12.1.The Parties are released from liability for partial or complete non-fulfillment of obligations under this Offer if such non-fulfillment was the result of force majeure circumstances.
12.2.Force majeure circumstances may include, in particular:
- natural disasters;
- military actions and emergencies;
- actions of government authorities;
- mass cyberattacks on Internet infrastructure;
- accidents in data centers or on backbone communication channels;
- other circumstances beyond the reasonable control of the Parties.
13. DISPUTE RESOLUTION
13.1.All claims related to the performance of this Offer are sent to the Contractor at the email address: support@mineguard.pro
13.2.The claim review period is up to 15 (fifteen) business days from the date of receipt.
13.3.If the dispute cannot be resolved through the claims procedure, the dispute shall be considered in accordance with the legislation of the Republic of Kazakhstan in a court at the location of the Contractor.
14. MISCELLANEOUS PROVISIONS
14.1.This Offer is governed by the legislation of the Republic of Kazakhstan.
14.2.The Contractor may unilaterally amend the terms of this Offer. The new version takes effect from the moment of its publication on the Website or within the period specified by the Contractor.
14.3.Continued use of the Service after the new version of the Offer takes effect is considered the Customer's consent to the amendments made.
14.4.The official communication channel between the Parties is the email address specified by the Customer during registration.
14.5.This Offer and all related documents (Privacy Policy, Consent for Personal Data Processing, Refund Policy) are drafted in the Russian language. In the event of a translation into other languages and discrepancies between language versions, the Russian language version shall prevail.
